1. Definitions

“Core Software” means the Open Sim Relay (OpenSR) core system, including its binaries, executables, libraries, documentation, and all related elements provided by Zappadoc and/or EKSIMRacing Foundation.
“Extension Software” means external modules designed to work with the Core Software, including but not limited to “IN (Game) Plugins” and “OUT Plugins,” whether created by Zappadoc , EKSIMRacing Foundation, or third parties.
“You” or “End User” means the individual or entity installing or using the Core Software.

2. License Grant

The Core Software is licensed, not sold.
You are granted a personal, non-exclusive, non-transferable right to install and use the Core Software in binary form only.

This license is granted free of charge for personal and non-commercial use only.
Commercial use of the Core Software requires a separate written license agreement. Please contact the copyright holder for details.

3. Restrictions on the Core Software

Unless expressly authorized in writing by Zappadoc and/or EKSIMRacing Foundation, you may not:

Reverse engineer, decompile, or disassemble the Core Software.
Modify, adapt, translate, or create derivative works of the Core Software.
Redistribute, publish, or share the Core Software binaries.
Sell, rent, lease, sublicense, or otherwise commercially exploit the Core Software.

4. Extension Software

Extension Software may be developed and distributed independently by third parties.
Developers of Extension Software retain full ownership and copyright of their work.
Extension Software may be released under any license chosen by its author (including open source, proprietary, commercial, or free).
The Core Software imposes no licensing restrictions on Extension Software.
Extension Software must not interfere with the proper functioning of the Core Software or violate the terms of this Agreement.

5. Updates and Termination

Zappadoc and/or EKSIMRacing Foundation may, at their discretion, provide updates, patches, or modifications to the Core Software.
This license will terminate automatically if you breach any of its terms.
Upon termination, you must cease all use of the Core Software and destroy all copies in your possession.

6. Ownership

The Core Software, including all associated intellectual property rights, remains the sole property of Zappadoc and EKSIMRacing Foundation.
No ownership rights are transferred to you under this Agreement.

Extension Software developed by third parties remains the sole property of its respective authors, who may distribute it under their chosen license terms.

7. Disclaimer of Warranty

The Core Software is provided “AS IS,” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

You assume all risks associated with the use of the Core Software.

8. Limitation of Liability

In no event shall Zappadoc , EKSIMRacing Foundation, or the author(s) be liable for any damages arising out of or related to the use or inability to use the Core Software, including but not limited to:

Data loss
Business interruption
Loss of profits
System failure or malfunction

Even if advised of the possibility of such damages.

Licensing and Pricing
EKSIMRacing has transitioned to a free-access model with the release of OpenSR. OpenSR is 100% free to use, replacing the previous licensing requirements for Ledsmaster and SLIMax Manager. While access to the software is no longer tied to a fee, we continue to operate as a nonprofit Foundation; any donations are greatly appreciated and go directly toward the continued development and support of our projects.

Legacy Licenses
We recognize and honor all licenses acquired by our users from 2009 to the present. While these legacy licenses remain valid for the older versions of our software, we strongly recommend that all users migrate to OpenSR to take advantage of the latest features and the permanent free-access model.

License Validity & Maintenance
For legacy software, licenses remain valid for 10 years from the initial activation date unless otherwise stated. For those still utilizing legacy versions, donations made during this period will extend the expiration date by an additional 10 years. Should a legacy license expire in error, users may sign in to their account and submit a reactivation request, provided a donation was previously made. Please note that these expiration terms do not apply to OpenSR, which does not require a license or expiration renewal.

Privacy Policy:
The personal information are collected when your register your device to create your customer record for software support subscription and to generate your license key, these information ARE NOT SHARED WHIT ANY ONE OR ANY COMPANY and are kept CONFIDENTIAL. As soon as you no longer use the device you can ask EKSIMRacing to delete your customer record. As written in the FAQ the license Key is transferable to a new owner of the device (the software support subscription is NOT transferable and the new owner needs to complete the registration to get software support).

Refund Policy
Most EKSIMRacing software, including OpenSR, is provided free of charge. For our paid software, specifically MotionMax Manager, we provide free access to register your device so that you may fully test the functionality before purchase. Consequently, all sales for paid software are final, and no refunds are available after purchase.

In the event of extenuating circumstances, you may contact us to request a refund review. Exceptions are granted at the sole discretion of EKSIMRacing. If a refund is approved, a 10% administrative fee may be deducted from the total amount.

Applicability & Duration
These terms and conditions apply to OpenSR (which replaces Ledsmaster and SLIMax Manager), MotionMax Manager (version 1.x), and the digital dash Emulator (VDASH-EMU version 1.x). While OpenSR is 100% free, any future software that requires a license will be subject to these terms. Terms for licensed software expire after two years and shall renew automatically under the same conditions unless written notification is provided via our website, email, or public announcement.

Termination
EKSIMRacing reserves the right to terminate any account at its sole discretion or in the event of abuse. In cases of violation of these terms, the corresponding account and any associated paid licenses (such as for MotionMax Manager) may be banned and deactivated. This includes the revocation of access to our website and software support.

The software license requires a contribution to EKSIMRacing foundation (we accept only $ USD United States dollar and € EURO).

Refund Policy Addendum (Offline Licenses)

For certain customers, offline licenses may be granted for THE SOFTWARE, allowing use without an internet connection after initial activation. Due to the nature of offline licensing and the security measures in place, all offline license purchases are final and strictly non-refundable under any circumstances. The customer is responsible for the safekeeping of the means required to operate THE SOFTWARE in offline mode. In the event of loss or damage, a replacement device may be provided at the customer’s expense; however, the original offline license will be void and a new license will be generated exclusively for the original customer. The customer is entitled to up to three (3) free license regeneration during the validity period of the offline license. Any further license regeneration requests beyond this limit may incur additional fees or be subject to the licensor’s approval. Offline licenses for THE SOFTWARE are personal, non-transferable, and may not be sold, assigned, or transferred to any other party under any circumstances. Under no circumstances does loss, damage, or replacement of the device entitle the customer to a refund. By purchasing and activating an offline license, the customer acknowledges and agrees to these conditions.

PERSONAL & COMMERCIAL LICENSE AGREEMENT (ABSTRACT)

This Personal & Commercial License Agreement (“Agreement“) is entered into between EKSIMRacing Foundation (“Publisher”), Zappadoc (“Author”), and the individual or entity who downloads, installs, or uses the software (“Licensee“).

1. LICENSE GRANT

Subject to payment of the License Fee (defined below), the Publisher and Author hereby grant the Licensee a non-exclusive, non-transferable, non-sublicensable license to install, use, and integrate the full version of the zCube Python Developer Kit (“THE SOFTWARE“) for both personal and commercial purposes, in accordance with this Agreement.

2. LICENSE FEE

Licensee agrees to pay a one-time, non-refundable License Fee in the amount specified at the time of registration or purchase (in USD or EUR) to the Publisher. Upon confirmation of payment and generation of the license key, Licensee will be able to activate THE SOFTWARE.

3. PERMITTED USES

The Licensee may:
a. Integrate THE SOFTWARE into commercial or proprietary products or services.
b. Modify THE SOFTWARE for internal development or customization.
c. Distribute compiled applications that incorporate THE SOFTWARE, provided that:

THE SOFTWARE is not distributed or exposed as a standalone module, library, script, or API.
The resulting application represents a meaningful and original product, not a simple wrapper or direct derivative of THE SOFTWARE.

4. RESTRICTIONS

The Licensee may not:
a. Redistribute, sell, sublicense, or otherwise transfer THE SOFTWARE as a standalone product.
b. Reverse engineer, decompile, or disassemble THE SOFTWARE, except as expressly permitted by applicable law.
c. Share, lend, or expose the license key or license file to unauthorized users.
d. Use THE SOFTWARE in a way that competes with the original product, including offering it as a developer kit or similar utility.

5. INTELLECTUAL PROPERTY

All intellectual property rights in and to THE SOFTWARE, including but not limited to source code, compiled binaries, documentation, designs, and algorithms, remain the exclusive property of Zappadoc.

Licensee agrees to comply with all applicable export laws and restrictions. THE SOFTWARE may not be exported, re-exported, or used in violation of international export control laws or sanctions.

11. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of a jurisdiction selected by the Publisher or Author at the time of dispute resolution, which may include but is not limited to the laws of France or Canada.
Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of the selected jurisdiction, and the Licensee hereby submits to the jurisdiction and venue of such courts.

12. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties with respect to THE SOFTWARE and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.

By installing, activating, or using THE SOFTWARE, the Licensee acknowledges having read, understood, and agreed to all terms and conditions stated herein.

PERSONAL & COMMERCIAL LICENSE AGREEMENT (ABSTRACT)

This Personal & Commercial License Agreement (“Agreement”) is entered into between EKSIMRacing Foundation (“Publisher”), Zappadoc (“Author”), and the individual or entity who downloads, installs, or uses the software (“Licensee”).

LICENSE GRANT

Subject to payment of the License Fee (defined below), the Publisher and Author hereby grant the Licensee a non-exclusive, non-transferable, non-sublicensable license to install, use, and integrate the full version of the zCube Python Developer Kit (“THE SOFTWARE”) for both personal and commercial purposes, in accordance with this Agreement.

PERMITTED USES

THE SOFTWARE is not distributed or exposed as a standalone module, library, script, or API.

The resulting application represents a meaningful and original product, not a simple wrapper or direct derivative of THE SOFTWARE.

RESTRICTIONS

The Licensee may not:
a. Redistribute, sell, sublicense, or otherwise transfer THE SOFTWARE as a standalone product.
b. Reverse engineer, decompile, or disassemble THE SOFTWARE, except as expressly permitted by applicable law.
c. Share, lend, or expose the license key or license file to unauthorized users.
d. Use THE SOFTWARE in a way that competes with the original product, including offering it as a developer kit or similar utility.

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, or non-infringement.
In no event shall the Publisher, Author, or any contributor be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including procurement of substitute goods, loss of data or profits, or business interruption) arising in any way out of the use of THE SOFTWARE, even if advised of the possibility of such damage.

YOU MUST READ AND RESPECT THE HEALTH AND SAFETY PRECAUTIONS INCLUDED WITH YOUR SIMULATOR MACHINE.

YOU FULLY UNDERSTAND: CAR RACING SIMULATOR INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND POSSIBLY DEATH.

EXPORT COMPLIANCE

Licensee agrees to comply with all applicable export laws and restrictions. THE SOFTWARE may not be exported, re-exported, or used in violation of international export control laws or sanctions.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of a jurisdiction selected by the Publisher or Author at the time of dispute resolution, which may include but is not limited to the laws of France or Canada.
Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of the selected jurisdiction, and the Licensee hereby submits to the jurisdiction and venue of such courts.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties with respect to THE SOFTWARE and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.

By installing, activating, or using THE SOFTWARE, the Licensee acknowledges having read, understood, and agreed to all terms and conditions stated herein.

EKSIMRacing is a foundation a non profit organization dedicated to promote the sim racing since 2007. All our projects are funded by donations or self-financed with equity and we’re all volunteers.

** IMPORTANT: READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY **

License and Pricing:
The software license is almost free it requires a simple contribution of any amount to EKSIMRacing foundation (we accept only $ USD United States dollar and EURO € ).

General Terms and Conditions (abstract):
Redistributing our software shall not be allowed without our prior written consent (send an email with a short description of your company). Downloading the application from other website shall not be allowed without our prior written consent and is NOT RECOMMENDED.

Professional License (abstract):
if you supply hardware with device (custom Steering wheel modded, shiftlight/buttons box, cockpit, dasboard, simulator, … ) or provide a racing simulation services for drivers of any kind (services for entertainment or any other type of simulation service) that use our software or demo it with them read this FAQ to get all benefit of PRO Registration.

Privacy Policy:
The personal information are collected when your register your device to create your customer record for software support subscription and to generate your license key, these information ARE NOT SHARED WHIT ANY ONE OR ANY COMPANY and are kept CONFIDENTIAL. As soon as you no longer use the device you can ask EKSIMRacing Foundation to delete your customer record. As written in the FAQ the license Key is transferable to a new owner of the device (the software support subscription is NOT transferable and the new owner needs to complete the registration to get software support).

Refund Policy:
EKSIMRacing Foundation offers a free access to our software to register your device, so that you have time to test out before you purchase. this why this is important to match the system requirements and install the software before registering your license. Therefore, all sales are final and no refunds are available after purchase.
If you feel you have an extenuating circumstance that requires a refund, you may contact us with your reasons for requesting a refund and we will review it. Refund exceptions are determined at the sole discretion of EKSIMRacing Foundation. If a refund is given, a 10% admin fee can be deducted from the refund amount.
